EULA - End User License Agreement

ACCEPTANCE AND DISCLAIMER OF WARRANTY

The software contained in this CD is provided to the LICENSEE “AS IS” without warranty of any kind. The entire risk as to the results, usefulness and performance of the software is assumed by the LICENSEE ADVANCED & BEST PRODUCTS PTE LTD disclaims all warranties, either express or implied, including but not limited to, implies warranty of merchantability, fitness for a particular purpose, correspondence to description, title and non-infringement. FURTHER, ADVANCED & BEST PRODUCTS PTE LTD specifically disclaims any express or implied warranties regarding lack of viruses, accuracy or completeness of responses, results, lack of negligence, and lack of workmanlike effort, for the software.

LIMITATION OF LIABILITY

In no event shall ADVANCED & BEST PRODUCTS PTE LTD be liable for any direct, consequential, indirect, incidental or special damages whatsoever, including without limitation, damages for loss of business profits, business interruption, loss of business information, and the like, arising out of the performance, use of, or inability to use, all or part of either the software, even if ADVANCED & BEST PRODUCTS PTE LTD has been advised of the possibility of such damages, the above limitation may not apply.

SUPPLY POLICY

Title and Proprietary Rights: Licensee acknowledges and agrees that the software is proprietary to ADVANCED & BEST PRODUCTS PTE LTD and/or its licensors, and is protected under international laws. Licensee further acknowledges and agrees that all rights, title and interest, in and to the Software, including intellectual property rights, are and shall remain with ADVANCED & BEST PRODUCTS PTE LTD and/or its licensors. Unauthorized reproduction or distribution is subject to civil and criminal penalties.

Use of the Software: ADVANCED & BEST PRODUCTS PTE LTD grants Licensee the limited right to use the Software included in the package with this license subject to the terms and conditions of this Agreement. Licensee agrees that the Software will be used solely for internal purposes. Licensee may not use the Software to offer data processing services to third parties, including but not limited to timesharing, facilities management, outsourcing or service bureau use, or any other third party commercial purpose or gain. Only one copy of the software maybe installed on a single computer at any one time.
